01Agreement to these terms

These Terms of Use govern your use of aariusdumas.com, its subdomains, live-stream pages, client galleries we link to, and any content we publish there (together, the “Site”), operated by Aarius Dumas Productions LLC, an Ohio limited liability company (“ADP”, “we”, “us”). By using the Site you agree to these terms. If you do not agree, please do not use the Site.

02Other terms that may apply

Some parts of the Site have their own terms, which apply alongside these:

• Equipment Rental Terms for gear and LED wall bookings.
• Privacy Policy for how we handle personal information.
• SMS Terms of Service for text messages.
• A signed proposal, quote or production agreement for client projects, which controls if it conflicts with these terms.

03Who may use the Site

You must be at least 13 years old to use the Site, and at least 18 (or the age of majority where you live) to book services, rent equipment or make a payment. If you use the Site for an organization, you confirm you are authorized to accept these terms for it.

04Live streams and broadcasts

Our live page and embedded players show events we produce, usually on behalf of a client.

• Personal viewing only. You may watch streams and replays for your own non-commercial use. You may not record, capture, rebroadcast, restream, clip for redistribution, or publicly exhibit a stream, in whole or in part, without written permission from ADP and the event owner.
• Event content belongs to its owners. Speakers, performers, music, logos and program content are owned by the event host or others. A stream being public does not grant you any license to it.
• No guarantee of availability. Streams depend on venue internet, third-party platforms and conditions outside our control. Streams may start late, be interrupted, change quality, end early, or be cancelled, and replays may be edited or removed. We are not liable for any interruption.
• Chat and comments. Where a chat is offered (often through a third-party platform), keep it respectful and lawful. We or the event host may hide messages and remove participants. Chat providers’ own terms also apply.
• Recorded in public settings. Events we stream may show audiences and attendees. If you believe you appear in a stream or replay and want a review, contact us and we will work with the event host.
• Not professional advice. Views expressed in a stream are those of the speakers, not ADP.

05Our content and intellectual property

Unless otherwise noted, the Site’s text, photos, video, graphics, logos, design and code are owned by ADP or used with permission, and are protected by copyright and trademark law. “Aarius Dumas Productions” and our logo are our marks. Client names and logos appear to describe work we performed and remain the property of their owners. You may view and share links to Site pages; you may not copy, download, modify, reproduce, sell or create derivative works from our content without written permission.

06Portfolio and client work

Case studies and reels show work produced for clients, displayed with their permission or as allowed by our agreements. Displaying a client’s work does not imply that client endorses anything beyond the work shown. If you are a client and want a piece adjusted or removed, contact us.

07Quotes, bookings and payments

Prices, packages, availability and rates shown on the Site are for information and may change; some rates are marked as samples. A request through the Site is not a booking until we confirm it in writing. Online rentals are processed by Stripe and are governed by our Rental Terms. Sales tax, if any, is calculated at checkout.

08Acceptable use

When using the Site you agree not to:

• break any law or infringe anyone’s rights;
• submit false, misleading or someone else’s information in a form, booking or payment;
• try to gain unauthorized access to the Site, our systems, streams or client galleries, or interfere with their security or operation;
• scrape, harvest or bulk-download content, or use bots to submit forms or bookings;
• upload or send malware, spam or harassing content;
• use the Site, our content or our streams to train or build commercial AI models without written permission.

09Information you send us

When you send a request, brief, files or feedback, you confirm you have the right to share it, and you allow us to use it to respond to you and deliver services. We handle personal information as described in our Privacy Policy. Ideas or suggestions you volunteer may be used without obligation to you.

10Third-party services and links

The Site links to and embeds third-party services such as YouTube, Vimeo, Facebook, Google, Stripe and our client gallery host. Their terms and privacy policies apply to your use of them, and we are not responsible for their content, availability or practices.

11Accessibility

We aim to make the Site usable for everyone and to follow WCAG 2.1 AA practices, including captions where available on our own media. If something on the Site is hard to use, contact us and we will help and work to fix it.

12Disclaimers

The Site, its streams and content are provided “as is” and “as available”. To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. Guides and articles are general information, not legal, technical or professional advice for your specific situation.

13Limitation of liability

To the fullest extent the law allows, ADP will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill, arising from your use of the Site or its streams. Our total liability for any claim relating to the Site is limited to $100. These limits do not apply to liability that cannot be limited by law, and do not change the terms of any signed client agreement.

14Indemnity

You agree to defend and indemnify ADP against claims, losses and costs (including reasonable attorney fees) arising from your misuse of the Site or its streams, or your breach of these terms.

15Copyright concerns

If you believe content on the Site infringes your copyright, email us with a description of the work, where it appears on the Site, your contact details, and a statement that you have a good-faith belief the use is not authorized. We will review it promptly and remove material where appropriate.

16Changes, suspension and termination

We may change the Site, its streams or these terms at any time. The “last updated” date above shows the latest version, and continued use after a change means you accept it. We may suspend or restrict access for anyone who breaches these terms.

17Governing law and disputes

These terms are governed by the laws of the State of Ohio, without regard to conflict-of-law rules. Before filing a claim, you agree to contact us and try to resolve the issue informally for at least 30 days. Any dispute that is not resolved will be brought in the state or federal courts located in Franklin County, Ohio, and you consent to their jurisdiction.

18General

If any part of these terms is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not transfer your rights under these terms; we may assign ours in connection with a merger or sale of the business. These terms are the entire agreement between you and us about the Site, except where another agreement listed above applies.
